GENERAL FUNCTIONS OF THE DISTRICT
Westlake Municipal Utility District No. 1 (hereafter referred to
as the District), is empowered, among other things, to finance,
purchase, construct, operate and maintain all works, improvements,
facilities and plants necessary for the supply and distribution of
water; the collection, transportation and treatment of wastewater;
and the control and diversion of storm water. The District may also
provide solid waste disposal and collection services. The District
is also empowered to establish, operate and maintain fire-fighting
facilities, independently or with one or more conservation and
reclamation districts, after approval by the Texas Commission on
Environmental Quality and the voters of the District.
The District is required to observe certain requirements of the City
of Houston, such as the limitation for the purposes for which the
District may sell bonds for the acquisition, construction, and
improvement of waterworks, wastewater, and drainage facilities and
the refunding of outstanding debt obligations; the limitation on the
net effective interest rate on such bonds and other terms of such
bonds; the requirement of approval by the City of Houston of
District construction plans; and the permitting of connections only
to lots and reserves described in a plat that has been approved by
the City of Houston and filed in the real property records of Harris
County. Construction and operation of the District’s drainage system
is subject to the regulatory jurisdiction of Harris County and
additional State of Texas and local agencies.
FORMAL DESCRIPTION OF THE DISTRICT AND ITS FACILITIES
The District is a political subdivision of the State of Texas;
Created by an order dated April 11, 1972 of the Texas Water Rights
Commission, the predecessor to the Texas Natural Resource
Conservation Commission, now known as the Texas Commission on
Environmental Quality, and operates pursuant to Chapters 49 and 50
of the Texas Water Code, as amended. At the time of creation the
District contained approximately 387.44 acres. Subsequent to
creation the District annexed two tracts totaling approximately 7.31
acres and presently contains approximately 394.75 acres of land. The
District is located approximately 23 miles west of the central
business district of the City of Houston, 6 miles east of the City
of Katy and 1 mile north of Interstate Highway 10. The District is
generally bounded on the west by Fry Road and on the east by
Greenhouse Road. South Mayde Creek generally forms the northern
boundary of the District. The District lies wholly within the
extraterritorial jurisdiction of the City of Houston and is within
the Katy Independent School District.
Development within the District began in 1972 and is almost
complete. The District provides water, wastewater and storm drainage
facilities to serve Westlake Forest, Sections One and Two, Westlake,
Section One, and Westlake Village, which comprise approximately
311.34 Acres. As of January 15, 2002, there were within the
residential portion of such subdivisions 1,259 constructed homes and
one vacant lot. The District also provides such water sewer and
drainage facilities to various commercial tracts including the West
Reserves located on both sides of the intersection of Fry Road and
Saums Road, comprising approximately 22.91 acres and approximately
13 acres of Westlake, Section One, platted as Reserves A, B, and C.
Reserves A and B are located on Fry Road, south of Saums Road and
Reserve C is located on the south side of Saums Road at the
intersection of Fry Road. The commercial reserves of Westlake,
Section One consist of retail shops, fast food and service related
stores. The West Reserves contain two shopping centers: Westlake
Plaza with small retail stores and Mayde Creek Emporium Center with
several consumer goods stores and a vacant service station lot.
24 Hour Fitness has relocated its store to another location
outside the district and its former space is vacant. A portion of
the West Reserves does not have above ground improvements. Further,
the District provides water lines to the perimeter of the East
Reserves, which does not have any improvements. Additional minor
water distribution, wastewater collection and storm drainage
facilities may be required to serve the East Reserves and 5.305
acres of the annexed tract.
STATUS OF DEVELOPMENT OF THE DISTRICT
Facilities Serving the District: The land within the District has
been developed as Westlake Forest, Section One and Two, Westlake,
Section One and Westlake Village and certain other commercial
reserves. The District is a mixed-use project with commercial
property on Fry Road and Saums Road, and residential property in the
interior portions of the District. The District has financed the
acquisition and construction of water distribution, wastewater
collection and storm drainage facilities, a water supply plant, and
a wastewater treatment plant. In addition, there are three permanent
water interconnects with neighboring districts. Further, all street
construction and paving necessary to provide access to all acreage
within the District has been completed, however, internal streets
may be required to be paved by the landowners of the East Reserves
and the undeveloped 5.305 acres annexed tract. According to the
Engineer, the water plant capacity and wastewater treatment plant
capacity are adequate for development of the entire District.
